Policies

Deposit Requirements:

• We require a minimum, non-refundable deposit of 20% of the total price of your session or event at booking. This deposit will be deducted from your final total that will be due immediately following photography services provided by Harley Rose Photography. 

Photo Rights:

• It is vital that you do not claim the photographs, that we capture, as your own. You may post them on social medias as long as you tag us and/or mention us in the description. Client must include a photo credit with the name of the photographer on all photos shared and distributed. If you fail to do this, we will reserve the right to deny you our services in the future.

• We reserve the right to use images created during any sessions or events for advertising, display, publication or other purposes. Original, edits, digital files and previews remain the exclusive property of Harley Rose Photography. If we photograph you and post the pictures on our website or social medias, we will post the ones we feel are best. If you are not happy with our choices, feel free to contact us regarding the situation. We will take down any pictures as necessary. In the event of any privacy requirements, please let us know. We will refrain from posting any requested images onto our website and social medias. For exclusive use of photos, without Harley Rose Photography using them for advertising purposes, please contact Harley Rose Photography to arrange this prior to booking. 

• Client will not use the Photos for any of the following purposes:

  • •  No Unlawful Use. Client will not use the photos in any unlawful manner, such as pornography or defamation.  

    •  No Products for Resale. Client will not use the photos in any goods or products where the photos are the primary value. (Printing out images for calendars, frames, posters, or other items for the sole purpose of selling.) An exception may include compensating Harley Rose Photography with profits earned through selling images captured by Harley Rose Photography. This exception may be discussed between the client and Harley Rose Photography. 

• Ownership: Harley Rose Photography retains the copyright to all images.

• ​Client Use: The Client is granted a personal use license. This means you can print images and share them on social media while mentioning or tagging Harley Rose Photography in the post(s).

• ​Commercial Use: Images may not be sold or used for commercial advertising without written permission or proper compensation to Harley Rose Photography.

• The Client agrees that Harley Rose Photography may use images from this session for promotional purposes, including social media, website portfolios, and marketing materials. (Optional: If you prefer to opt-out, please let the photographer know.)

Weather:

• If inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of Harley Rose Photography, we may suggest to use an alternate location or to reschedule the session. If a differing date does not work with scheduling conflicts, we may suggest cancelling the session for a full or partial refund of payment. 

• Harley Rose Photography reserves the right not put any equipment at risk for damage due to inclement weather conditions. 

Damages:

• In the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer, Harley Rose Photography will not be held accountable. We are willing to correct any mistakes resulting from any electronic malfunctions. You may be compensated by a Harley Rose Photography eGift card with an amount agreed upon between the client and Harley Rose Photography or by an equivalent session to retake the photos. 

• If any equipment or props are damaged during any session at the fault of the client, Harley Rose Photography reserves the right to add any costs of any damaged equipment to the final cost of the session and reserves the right to withhold all images until balance is paid in full. 

• Harley Rose Photography is not to be held responsible for any injuries, illnesses, or property damages that may occur from any photo sessions, events, or where Harley Rose Photography's services are being used. Each client has their own free will to avoid dangerous situations and activities that may relate to any photo session. 

Pricing & Payment: 

• The charges for all sessions are based on our standard price list. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the session is booked.

• No part of any order, including previews, will be delivered until the balance is paid in full. 

• If no other payments are received for your services, Harley Rose Photography will charge the card on file (if applicable) to obtain the remaining balance due. Images will not be delivered until the remaining balances of the provided services are paid in full.

No-Shows & Unpunctual Clientele:

• In the event of no shows, you may be invoiced a no-show fee of travel fees + 25% or more of the final cost of the event or session, depending on the location of session and length of time scheduled.

• In the event of unpunctual clientele, Harley Rose Photography reserves the right to remain at the location for exclusively the scheduled time frame. Additional fees may be added based on length of delays and/or sessions.

• Cancellation: If the Client cancels, the deposit is non-refundable.

• ​Rescheduling: If the Client needs to reschedule, at least 12 hours notice is required. A rescheduling fee may apply in certain cases.

• ​Photographer Incapacity: In the unlikely event the Photographer cannot perform due to illness or emergency, a list of qualified photographer replacements will be recommended, and a full refund (including deposit) will be issued.

• If client has not paid a 20% booking deposit and fails to attend their scheduled session without providing at least 12 hours notice to Harley Rose Photography, client will be billed via invoice for a cancellation fee equal to 50% of the total session price, plus a travel fee calculated at $1.00 per mile to the agreed location. Client acknowledges that this travel fee applies to any location and includes locations that otherwise qualify for standard travel fees waived under Harley Rose Photography's general policies. If an invoice is issued, it must be paid within 30 calendar days from the no-notice, no-show session date.

Client Responsibility 

• The Client is responsible for any damage caused to the Photographer’s equipment (cameras, lenses, lighting, etc.) or property by the Client, the Client’s guests, or the Client's pets during the session or event.

• Reimbursement: In the event of damage, the Client agrees to reimburse Harley Rose Photography for the full cost of professional repair or, if the item is beyond repair, the full replacement cost of the equipment at current market value. Payment for damages shall be due within 30 days of the Photographer providing a repair estimate or replacement quote.

• Safety & Termination: For the safety of the Photographer and the equipment, Harley Rose Photography reserves the right to immediately terminate coverage if the Photographer feels that equipment is at risk of damage due to the behavior of the Client or guests (including, but not limited to, intoxication, physical aggression, or unsafe environments). In such a case, no refunds will be issued for the remaining time.

• Limitation of Liability: While every care is taken, Harley Rose Photography is not responsible for compromised coverage due to causes beyond their control (e.g., weather, venue restrictions, or guest interference). The limit of liability for any damages shall not exceed the total price paid by the Client.

Miscellaneous:

• If we feel uncomfortable during a photoshoot, we reserve our right to leave. If you or anyone in your group makes any Harley Rose Photography associates feel uncomfortable, we will end the photo session and you will be charged at least 50% of the price for the session. Please do not ask us to do anything we may feel uncomfortable doing.

• If we feel we are not a good option for you as a photographer, whether due to scheduling conflicts or other reasons, we are happy to recommend other photographers in the area.

• If a pet or animal will be part of the photo session or event, they must be non-aggressive. Dogs, cats, horses, etc can get nervous around new people, which is understandable, but there is a difference between being nervous and aggressive. If your animal has a biting or injury causing history, please reconsider allowing them to attend a photo session. In addition to being non-aggressive, the owner/handler must be able to fully control/hold back the animals to avoid damage to photography equipment and props. Any injury or damage caused by the animals to the photographer, equipment, props, or other property will be full responsibility of the owner of the animal. Preferred: Any mammal that is of age to have proper rabies vaccination records, must have documents ready to present upon request. Certain farm animals may be an exception to this rule.

Editing:

• ​Our goal is to deliver beautiful, authentic images that reflect the session. Standard editing is applied to all delivered images and includes professional adjustments to color, contrast, exposure, and basic spot removal of small distractions. ​As a courtesy, we do remove distracting, unintended elements in the background, like unexpected foot traffic. 

• ​Major retouching requests, which are not included in your package include:  ​Body & Appearance Alterations such as any significant digital modification of physical appearance, such as body reshaping, extensive wrinkle removal, changing eye or hair color, or digital tanning. We cannot digitally add individuals who were not present at the session or remove subjects who were intended to be in the photograph. ​If you require a shot without a specific person present, please communicate this to your photographer during the session. 

• Each Image is carefully reviewed and individually selected and modified by Harley Rose Photography and is not outsourced for culling or editing of images. 

• AI (Artificial Intelligence): AI will not be used to alter someone's natural appearance (aside from slight touch ups by removing blemishes). AI is only used in Adobe Lightroom to add blur to backgrounds, denoise images for a clearer picture, and removal of objects or distracting backgrounds. AI may occasionally be used to add relevant objects to the background. 

• If you are unsatisfied with your pictures due to any of the following reasons:  glasses glare, blinking, not edited satisfactorily, blur, or other physical or technical problems, PLEASE contact us as soon as possible. Do not stay unsatisfied. We will help to make it right.

Weddings & Events

• Coverage Schedule:  The Photographer will follow the timeline provided by the Client/Planner. If there is not a specific timeline, Harley Rose Photography will capture the day in accordance with what events are occurring at any given moment and can switch to different locations upon request of the bride, groom, or other qualified person. Coverage ends at the agreed-upon time. Any requests for additional hours on the day of will be billed at Harley Rose Photography's hourly rates.

• Permits & Fees:  The Client is responsible for any venue photography fees or permit costs required for specific locations.

• Meals/Breaks:  For coverage exceeding 4 hours, the Client agrees to provide a seat to rest for the Photographer (and second shooter, if applicable) during the guest dinner service (if applicable). We do not require food to be provided as we do suffer from food allergies. We will bring our own snacks and drinks.

• Cooperation:  The Photographer is not responsible for missed shots due to guests' cameras/phones (the "Unplugged Ceremony" recommendation) or the absence of key individuals (e.g., family members missing for portraits). We will not edit any intentional people into or out of the images, as this will take away from our typical editing style.

General Liability Insurance 

• Harley Rose Photography is covered under General Liability insurance through Professional Photographers of America.
